STATEMENT
[1] We have considered the parties' proposals for the hearing of these claims. We have adopted a timetable which will maintain the substance of the programme proposed by the Australian Council of Trade Unions (the ACTU) but will also afford parties an opportunity to make a further submission after the Commonwealth Budget 2005-06 has been presented. The directions accompanying this statement are based on an assumption that the Budget will be presented on 10 May 2005. Should that turn out not to be correct, application may be made to vary the directions.
[2] The Commission will sit in Melbourne on 4, 5, 6, 7 and 8 April 2005 and, if necessary, on 11 April 2005. The directions provide for further submissions to be made after the Budget. Such submissions should be confined to matters arising from the Budget and official statistics or forecasts issued after 8 April 2005. The Commission will also sit, if necessary, on 19 May 2005 to hear any short supplementary oral submissions concerning such matters.
[3] We direct the parties to confer on the applications. Senior Deputy President Watson will be available to chair discussions on the claims and also on any measures to streamline the presentation of the parties' cases within the framework of the directions.
[4] Wherever possible submissions, affidavits and other materials should also be filed in electronic form by email to the following address: safetynet.review@air.gov.au. Provision of materials in electronic form is not a substitute for the normal hard copy filing and service requirements.
[5] So far as practicable all submissions, exhibits and other materials will be made available on a special page on the World Wide Web. That page will be accessible from the AIRC Home Page under the description Safety Net Review 2005.
DIRECTIONS
1. The ACTU, on behalf of the union applicants, and any party or intervener in support (other than those identified in paragraph 2) are to file and serve on all other parties and interveners by 4 February 2005:
(a) submissions in support of the applications;
(b) affidavits of any witness evidence in support of the applications.
2. The State and Territory Governments are to file and serve on all other parties and interveners by 11 February 2005:
(a) their submissions;
(b) affidavits of any witness evidence in support of the applications.
3. The submissions of all other parties together with affidavits of witness evidence, are to be filed and served on parties and interveners by 25 February 2005.
4. The ACTU and any party or intervener in support are to file and serve any reply on all other parties and interveners by 18 March 2005.
5. All other parties are to file and serve on the ACTU, interveners and each other any material in response to the ACTU's reply by 24 March 2005.
6. The ACTU may not file any material after 18 March 2005 unless by leave of the Commission, which leave shall not be granted unless:
(a) the material relates to economic data, academic studies or reports not available to the ACTU prior to that date; or
(b) there are special circumstances which warrant the filing of such material.
7. Subject to paragraph 9 no other party may file any material after 24 March 2005 unless by leave of the Commission, which leave shall not be granted unless:
(a) the material relates to economic data, academic studies or reports not available to the opposing party prior to that date; or
(b) there are special circumstances which warrant the filing of such material.
8. There will be liberty to any party to apply.
9. Any party wishing to make a further submission after the Commonwealth Budget
2005-06 should do so in writing to be filed in the Registry and served on all other parties and interveners on or before 17 May 2005.
